Louisiana health care providers sue state, claiming misoprostol law violates the Constitution

A lawsuit challenges Act 246, a new Louisiana law reclassifying mifepristone and misoprostol as controlled dangerous substances.

Ellie Schilling, along with co-counsel from The Lawyering Project and Lift Louisiana, filed suit against the State challenging the classification of mifepristone and misoprostol as controlled dangerous substances, arguing the law violates the equal protection clause of the Louisiana Constitution by discriminating on the basis of physical condition and endangering the health of pregnant women and others who rely on the medications. The State’s multiple attempts to dismiss the suit have all been denied.
